In April 2021, Neil Dymott Hudson shareholder Alan Graves successfully defended a plastic and reconstruction surgeon in a California Medical Board accusation. The accusation asserted repeated negligent acts involved in a surgical procedure of a thigh lift combined with high volume liposuction where the patient had a complication of wound infection.  The California Medical Board went after the physician’s license for alleged poor judgment in recommending the combined surgical procedure for the patient, inadequate record keeping of sterilization records, and an insufficient operative report.  At the Administrative Hearing, Alan Graves successfully defended the physician providing medical expert support that demonstrated the physician met the standard of care in all areas.  In June, the Administrative Law Judge ruled in favor of the physician and ordered the Medical Board’s Accusation dismissed in its entirety.

Alan B. Graves is a shareholder at Neil Dymott Hudson. His areas of practice include professional liability, business and employment matters and general civil litigation. For further information, Mr. Graves may be reached at (619) 238-1712.
