On May 9, 2013, Neil Dymott Hudson attorneys obtained a victory by Summary Judgment on behalf of a Project Manager and Human Resource Assistant in the Imperial County Superior Court. The defendants were accused by two plaintiffs of creating a hostile workplace in violation of public policy, which included alleged sexual harassment from another individual at the workplace.
Attorney Jon Ehtessabian filed Motions for Summary Judgment on behalf of the defendants (project manager and human resource assistant) on the grounds there was no triable issue of fact supported by admissible evidence to show defendants were part of or participated in creating a hostile work environment. The Court granted the motions for summary judgment on the grounds there was no evidence to support plaintiff’s allegations.
A Motion for Attorney Fees was subsequently filed on behalf of defendants. On August 15, 2013, motions were argued on behalf of defendants stating they were prevailing parties and had demonstrated plaintiffs’ allegations were unreasonable, frivolous, or meritless. After hearing arguments from both sides, the Court took the matter under submission. On October 3, 2013, the Court issued a ruling granting defendants Motion for Attorney Fees.
