Neil Dymott Successfully Opposes Surprise Ex Parte Motion for a TRO and Preliminary Injunction

In a real estate dispute, clients were brought into San Diego Superior Court on an ex parte basis, as their neighbors moved the Court for an emergency temporary restraining order and a preliminary injunction. The opposing party provided their motion paperwork the day before an 8:30 A.M. hearing, alleging issues of safety and irreparable harm.

Associate, Phillip E. Stephan opposed the motion, and appeared on behalf of the firm’s clients. Based on his paperwork and oral argument at the hearing, Mr. Stephan successfully convinced the Court that the motion should be denied, preventing the entry of a burdensome and unnecessary order that would damage the firm’s clients and their interests.  The clients were pleased with the outcome, and effective representation in a situation that distressed them and had the potential to impact their standing and reputation in the community.
