Robert Frank Successfully Defends Medical Clinic and Physician in Wrongful Death Suit

The plaintiffs were the surviving daughters of a 66 year old man who passed away from a heart attack. The plaintiffs alleged their father should have been given an angiogram to check for coronary artery disease when he presented to the clinic with symptoms of shortness of breath and chest discomfort, at the start of a routine run.  The plaintiffs asserted the symptoms, along with their fathers’ family history of heart disease (his father died of a heart attack at 66 years old) and elevated cholesterol, should have led the doctor to order an angiogram which would have found the severe 90% occlusion of his three main coronary arteries.  

Neil Dymott Shareholder Robert W. Frank defended both the Medical Clinic and the Physician in the suit. After hearing all arguments, the case went to the jury for deliberations. After one day of deliberations the jury returned a defense verdict on November 19, 2015, for the Clinic and physician.
