Defense Verdict in Medical Malpractice Suit
Clark R. Hudson obtained a 10-2 defense verdict on behalf of a physician in a malpractice suit for allegations involving breached standard of care and lack of informed consent. Plaintiff claimed Defendant performed an unauthorized surgical procedure on her and while performing said procedure, permanently damaged her right ureter. Plaintiff filed suit for $250,000 pain and suffering, and a loss of earnings of $75,000 to $350,000.
Trial lasted six days and after seven hours of deliberations, the jury verdict was 10-2 for the defense. Plaintiff’s settlement demand was $249,999.
